To Do List Joke

When I returned home from college for a break, I noticed a paper posted on the refrigerator. It listed some goals my dad had set for himself: Help wife more; lose weight; be more productive at work. I promptly added: "Send Michelle money every month." A few days later my brother wrote: "Make payments on car for Jason." Then my boyfriend joined in with: "Buy Tom a Jeep." Finally my father added a new goal to his amended list: "Wean kids."

Another Commercial Mortgage Broker Gets Cheated Out of a Huge Loan Fee

This week we came across a situation where a commercial mortgage broker took a commercial loan package to a big hard money lender (not us). The hard money lender issued a term sheet, but like all hard money lenders, its rates were less favorable than those of a bank. The borrower refused to sign the term sheet and hired a new commercial mortgage broker.

The new mortgage broker shopped the package around, and, by honest coincidence, ended up taking the package back to the very same big hard money lender (a lender much larger than my own shop). This time the borrower capitulated and took the loan.

Now the first mortgage broker surprisingly had a signed fee agreement. Hooray! The agreement even said that the borrower couldn't circumvent the broker - another huge plus. If the first mortgage broker were to sue the borrower, he would probably win a judgment for $38,000.

Unfortunately the contract did NOT provide for arbitration. This was a fatal error. Now the broker has to hire an attorney and litigate the matter in civil court. It will take him three years and $40,000 in legal fees. And while the broker's chances of winning are good, a positive outcome is not guaranteed. If he loses, he'll owe the opposing counsel's $40,000 in legal fees, on top of the $40,000 in legal fees he'll have to pay his own attorney.

Bottom line: The broker will never do it. His fee agreement is economically unenforceable. By failing to buy my $199 fee collection training course and fee agreement, he just cost himself $38,000.
